Service Agreement

1. THE CONTRACTUAL RELATIONSHIP

This Service Agreement (“Agreement”) constitutes a legally binding contract between you (“Member”, “User”) and https://www.sugarmommaindia.com (“The Platform”, “We”, “Us”). By accessing the Platform, creating a profile, or joining the 600+ Daily Waitlist, you acknowledge that you have read, understood, and agreed to be bound by these terms. If you do not agree with any part of this Agreement, you must immediately cease all use of the Platform.

2. ELIGIBILITY & THE 18+ MANDATE

The Platform is an exclusive social medium for consenting adults only.

  • Age Requirement: You represent and warrant that you are at least 18 years of age. Membership for anyone under 18 is strictly prohibited.
  • Verification: We reserve the right to conduct AI-driven facial recognition and government-issued ID checks to confirm your age and identity. Submission of fraudulent or misleading documentation will result in immediate termination of access.
  • Ineligibility: Individuals previously convicted of a felony, sex-related crime, or any criminal offense under Indian law or in any other jurisdiction are strictly barred from accessing the Service.

3. SCOPE OF SERVICE: THE INTERMEDIARY SHIELD

In accordance with Section 2(1)(w) of the Information Technology Act, 2000 (India), https://www.sugarmommaindia.com operates solely as an Intermediary.

  • The Medium: We provide a digital infrastructure for Elite Lifestyle Networking, Mentorship, and Meaningful Companionship.
  • No Agency: We are not a matchmaking agency, escort service, or transactional broker. We do not organize or facilitate offline meetings, nor do we endorse personal financial transactions between members.
  • Self-Directed Conduct: All interactions, including communication and any offline meetings, are self-directed and at the sole risk of Members. The Platform bears no responsibility for any incidents arising from such interactions.

4. THE “600+ DAILY WAITLIST” & AI CONCIERGE

Access to the Platform is a privilege, not a right.

  • Vetting Process: All applicants enter a Daily Waitlist. Our AI Concierge evaluates profiles based on integrity, professional standing, and social compatibility to maintain a high-quality community.
  • Discretionary Access: We reserve the right to deny or revoke membership at any time, without prior notice, if a profile fails to meet our standards of Quality Excellence.
  • Membership Renewal: Continued access is contingent on maintaining compliance with the Code of Conduct and active profile verification.

5. PROHIBITED CONDUCT & ZERO-TOLERANCE POLICY

The following conduct is strictly prohibited and will result in a permanent ban:

  • Illegal Solicitation: Offering, or advertising escort services, prostitution, or human trafficking.
  • Prohibited Terminology: Using transactional or financial language suggesting direct compensation (e.g., “pay-per-meet,” “allowances”). The Platform emphasizes Private Social Alliances and Mutual Respect.
  • Financial Exploitation: Soliciting loans, investments, or personal financial transfers from other members.
  • Harassment & Deception: Sending unsolicited explicit content, stalking, impersonation (“catfishing”), or any behavior causing distress to other members.
  • Illegal Activity: Engaging in any activity that violates Indian law or the laws of your jurisdiction.

6. PRIVACY & DISCRETION (GAUSSIAN PROTOCOL)

Privacy is our paramount priority.

  • Image Masking: Gaussian Blur technology protects your identity during initial discovery. You control who can view your high-resolution profile images.
  • Confidentiality: Members must maintain strict confidentiality regarding other members’ identities. Sharing screenshots or personal data without consent constitutes a material breach of this Agreement.
  • Data Protection: We comply with applicable Indian privacy laws. Personal data is stored securely and used only for operational purposes, including AI profile verification.

7. SUBSCRIPTION, FEES, AND REFUND POLICY

  • Access Fees: Membership fees are charged for access to the curated Registry and AI-enhanced features.
  • No-Refund Policy: Due to the immediate allocation of digital resources and the AI Concierge vetting process, all fees are non-refundable once access is granted.
  • Chargeback Protection: Fraudulent chargebacks will be contested and reported to the Cyber Cell of India under the IT Act.

8. LIMITATION OF LIABILITY & INDEMNIFICATION

  • Offline Risk: We are not responsible for any offline interaction. Members accept full responsibility and risk for any in-person interactions.
  • No Warranty: The Service is provided “as-is.” The Platform does not guarantee specific connections or the accuracy of member-provided information.
  • Indemnification: Members agree to indemnify https://www.sugarmommaindia.com against claims, damages, or legal costs arising from breaches of this Agreement or prohibited conduct.

9. COMPLIANCE WITH INDIAN LAW & GRIEVANCE REDRESSAL

  • Governing Law: This Agreement is governed by the laws of the Republic of India.
  • Grievance Officer: In accordance with the IT Rules 2021, any complaints must be directed to: compliance@sugarmommaindia.com.
  • Jurisdiction: Any legal disputes shall fall under the exclusive jurisdiction of courts in New Delhi or Mumbai.

10. TERMINATION

We reserve the right to terminate your membership at any time, with or without cause. Grounds include:

  • Breach of the Code of Conduct.
  • Submission of false information during AI verification.
  • Violation of Exquisite Lifestyle standards or applicable Indian laws. Termination will be communicated via email, and all platform access will be revoked immediately.
